These Terms and Conditions ("Terms") govern your use of the Vigo MD website and services, operated by Miles Wealth Ventures LLC ("Company," "we," "us," or "our"). By accessing or using our platform at vigomd.com, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Vigo MD is not a healthcare provider. We are a technology platform that facilitates the exchange of information between users and independent licensed clinicians. We do not provide medical advice, diagnosis, or treatment. All clinical decisions are made by independent, licensed healthcare professionals.
Vigo MD provides administrative support and telecommunications infrastructure for scheduling, communications, and virtual consultations with licensed healthcare providers. Our platform enables you to complete health questionnaires, communicate with providers, and receive prescribed treatments for men's health conditions.
Your use of our Services is subject to our Privacy Policy, which describes how we collect, use, and share your information. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.
To use certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration, maintain the security of your password and account credentials, and accept responsibility for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
Prescriptions may be filled by one or more licensed pharmacies partnered with our platform. Prescriptions may be transferred between pharmacies as needed. Shipping times may vary based on your location and product availability. You are responsible for managing any temperature-sensitive products upon delivery. All medications are shipped in discreet, unmarked packaging.
Your prescribing provider may require laboratory work or other testing as part of your treatment plan. If required, you must complete such testing within the timeframe specified by your provider. Failure to complete required testing may result in modification or discontinuation of your treatment.
By purchasing a treatment plan, you authorize us to charge your payment method for the applicable fees. Subscription plans auto-renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time. Third-party payment processors handle all payment transactions, and their terms apply to your payments.
Most sales are final. Clinical consultation fees are generally non-refundable after the service has been provided. Medications are non-returnable except in cases of pharmacy error or damage during shipping. If you believe you are entitled to a refund, please contact our support team at support@vigomd.com.
From time to time, we may offer promotional pricing or special offers. Additional terms may apply to such promotions, which will be disclosed at the time of the offer.

Any feedback, suggestions, or ideas you provide regarding the Services grants Vigo MD a worldwide, royalty-free, fully paid-up, non-exclusive, perpetual, irrevocable, transferable, and fully sublicensable license to use, reproduce, modify, and distribute such content for any purpose.
All content on the platform, including text, graphics, logos, images, software, and other materials, is the property of Vigo MD or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may access the Services for personal, non-commercial purposes only.
Vigo MD, the Vigo MD logo, Vital V3 Protocol, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates. You may not use such marks without our prior written permission.
We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

You may opt out of promotional communications at any time by following the unsubscribe instructions in those messages.
The Services may contain links to third-party websites, content, or resources. We are not responsible for and do not endorse any third-party materials, and we shall not be liable for any damage or loss arising from your use of or reliance on any such materials.
We may suspend or terminate your access to the Services at any time, for any reason, without prior notice. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VIGO MD, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (1) $100.00 OR (2) THE AMOUNT YOU PAID TO US IN THE ONE-MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless Vigo MD and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of another.
BY USING THE SERVICES, YOU AND VIGO MD ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION. Any disputes arising under these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. Arbitration shall be conducted on an individual basis only; class arbitration and class actions are not permitted.
You acknowledge that any breach or threatened breach of these Terms may cause irreparable harm to Vigo MD, and that we may seek equitable relief in any court of competent jurisdiction in addition to any other remedies available.
IF FOR ANY REASON A DISPUTE PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU AND VIGO MD EACH WAIVE ANY RIGHT TO A JURY TRIAL. YOU ALSO AGREE THAT YOU MAY BRING CLAIMS AGAINST US ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Any claim or cause of action arising out of or related to your use of the Services must be filed within one (1) year after such claim or cause of action arose, or it shall be permanently barred.
The Services are controlled and operated from the United States. We make no representation that the Services are appropriate or available for use in other jurisdictions. Access to the Services from jurisdictions where the content is illegal is prohibited.
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions of these Terms. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
